Bill Passed Last Week Ensures Murderers Do Not Profit From Their Crimes

gavelI was proud to lead unanimous Senate passage of a bill that will clarify state law to prevent a beneficiary who has been found not guilty by reason of mental defect or disease from receiving an inheritance from his or her victim. I introduced this bill after hearing about the case of Heather Messenger. Heather was killed by her husband, David Messenger, who was later found not guilty by reason of mental disease or defect. Despite the fact that he murdered his pregnant wife, David Messenger was still able to inherit her estate.

Senate Bill 213 prevents a defendant from financially benefitting from the killing of another person when the defendant is a named beneficiary of the estate or life insurance policy of their victim. The bill passed the state Senate last week with unanimous, bipartisan support. It now moves to the House of Representatives for further consideration. Current law states a murderer who is found not guilty due to mental illness or defect can inherit the estate of the deceased. This bill will amend current law so murderers do not profit from their crimes. This bill closes a loophole that allowed David Messenger to inherit over $400,000 from his deceased wife's estate. It is critical that we pass this law to prevent an injustice like we saw in the case of Heather Messenger's murder.
